Agreement to Terms
By using AsuTech's services, you acknowledge and agree to these Terms of Service.
Eligibility
- All clients must be 18 years of age or older to utilize AsuTech's server hosting services.
Payment, Billing, and Services
- PayPal is the sole accepted form of payment.
- Services are billed in advance on a prepaid basis.
- Payment must be received prior to service activation.
- In the event that your service is suspended for lack of payment, your invoice must be settled prior to service reactivation.
Credits and Refunds
- Refunds may be requested within 14 days of a client's first-ever purchase with AsuTech. The refund period is based on the start of the client's business relationship with AsuTech and does not reset or renew when purchasing additional services, ordering replacement services, creating new accounts, using alternate payment methods, or otherwise reordering service. Refunds are generally not available for services terminated for abuse, malicious activity, chargebacks, violations of these Terms, suspected refund abuse, account cycling, bad-faith use of the refund policy, or activity that threatens AsuTech, other clients, or service providers. AsuTech reserves the right to approve, deny, limit, or modify refunds at its discretion.
- After a client's initial 14-day refund eligibility period, payments are generally non-refundable. AsuTech may, at its discretion, issue account credit, partial refunds, service extensions, or other adjustments for unused service time, billing corrections, accidental overpayments, billing date adjustments, service-related issues, or other circumstances AsuTech considers appropriate.
- Transaction fees, payment processing fees, setup fees, add-ons, and third-party costs may be non-refundable unless otherwise required by law or approved by AsuTech.
- Account credits are not cash balances, are not transferable, and may only be used toward future AsuTech services unless otherwise agreed by AsuTech.
- Chargebacks, payment disputes, or payment reversals may result in immediate suspension or termination of services. Clients are encouraged to contact AsuTech first to resolve billing concerns before opening a payment dispute.
Suspension and Termination
- AsuTech may suspend or terminate services for non-payment, abuse, security risk, violation of these Terms, or activity that threatens service stability.
- When practical, AsuTech will provide notice and an opportunity to resolve the issue. For urgent security, abuse, chargeback, or infrastructure-risk situations, AsuTech may act immediately without prior notice.
- Upon cancellation, suspension, termination, non-payment, or chargeback, access to the affected service may be restricted or removed.
- Access to data, backups, or previously assigned IP addresses after cancellation, suspension, or termination is not guaranteed.
Data Backups and Retention
- AsuTech performs daily backups, retained for a period of up to 30 days. These backups are stored in an encrypted format on a third-party service for additional protection.
- Clients are responsible for maintaining their own independent backups of all files, configurations, databases, and server data.
- AsuTech may retain service data and available backups for up to 30 days after cancellation or suspension, but retention is not guaranteed.
- AsuTech may assist with data retrieval or restoration when practical, but access to cancelled, suspended, or terminated services is not guaranteed.
- Clients should download and verify their own backups before cancelling service or allowing invoices to become overdue.
- Service data may be deleted sooner in cases involving abuse, malicious activity, security risk, chargeback, provider requirement, legal requirement, storage failure, or other operational necessity.
Storage and Service Use
- AsuTech services may only be used for files and data reasonably related to the active service provided.
- Clients may not use AsuTech as general-purpose storage, backup storage, file sharing, media hosting, archive hosting, or software distribution unrelated to the purchased service.
- AsuTech may remove unrelated or excessive files and may suspend or terminate services that misuse storage resources.
IP Address Policy
- IP addresses assigned to client services remain the property of AsuTech, its upstream providers, or the applicable network provider. Clients are granted use of assigned IP addresses only while the related service remains active and in good standing.
- AsuTech may change, remove, rotate, or reassign IP addresses when necessary for network maintenance, provider changes, abuse handling, security reasons, service migration, non-payment, cancellation, or operational needs.
- Upon cancellation, suspension, termination, non-payment, or chargeback, assigned IP addresses may be released or reassigned without notice.
- Clients may not use assigned IP addresses for spoofing, scanning, unauthorized proxying, denial-of-service activity, reputation abuse, spam, evasion, or any activity that harms AsuTech, other clients, or upstream providers.
Support Scope
- AsuTech provides support for core hosting-related issues, including service availability, network connectivity, firewall-related issues, control panel access, basic service configuration, billing questions, and backup restoration when available.
- AsuTech does not guarantee support for third-party mods, plugins, scripts, custom server files, client-created configurations, game engine bugs, outdated software, or issues caused by client changes.
- AsuTech may decline support for software, files, or configurations that are insecure, abusive, unsupported, excessively outdated, or outside the intended use of the service.
- Clients are responsible for managing their own server files, passwords, administrators, mods, plugins, configurations, and community-specific settings.
Malicious Activity
- Any activity deemed malicious by AsuTech may result in suspension and/or termination of services. Examples of malicious activity include, but are not limited to, spoofing another client's server or domain, circumventing user or application isolation, harvesting player information for illegitimate use, and deliberate abuse of security vulnerabilities.
- This encompasses actions such as probing the host firewall, engaging in denial of service attacks whether maliciously or for "testing" purposes, and any behavior that causes harm to the host machine, neighboring clients, or the service provider.
- AsuTech reserves the right to determine what constitutes malicious activity at its discretion.
Security and Availability
- AsuTech employs its best efforts to secure, maintain, and ensure the availability of services.
- While AsuTech strives to safeguard client data and uphold service continuity, uninterrupted service, error-free operation, data preservation, specific network performance, or continued availability are not guaranteed.
- No Service Level Agreement (SLA) is officially provided unless stated in a separate written agreement.
- Clients are encouraged to implement their own security measures and acknowledge the inherent risks associated with online services.
Limitation of Liability
- AsuTech provides services on an "as-is" and "as-available" basis.
- AsuTech's total liability for any claim related to a service is limited to the amount the client paid for the affected service during the three months immediately before the issue occurred.
- AsuTech is not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business, lost player activity, loss of goodwill, loss of data, service interruption, downtime, or inability to access a service.
- AsuTech is not responsible for damages or losses caused by third-party providers, upstream networks, payment processors, control panels, game developers, mods, plugins, client configurations, client actions, malicious attacks, denial-of-service attacks, force majeure events, or circumstances outside AsuTech's reasonable control.
Intellectual Property
- AsuTech is an independent hosting provider and is not affiliated with, endorsed by, sponsored by, or officially associated with any game developer, publisher, platform, or rights holder unless explicitly stated otherwise.
- All game titles, names, logos, trademarks, software, engines, artwork, assets, and related intellectual property remain the property of their respective owners.
- Clients are responsible for ensuring they have the legal right to use any game files, server binaries, mods, plugins, maps, assets, or other content uploaded to or used with AsuTech services.
- AsuTech may remove or disable access to content or services that appear to infringe intellectual property rights or create legal risk.
